but a toyshop like that should know how to handle a MOC, wouldn't you think, so I thought why not, let's try,

So this one's all on me for not asking for better packaging. Gave him positive feedback, but wrote about the poor packaging.
 
No toy dealer should need instructions on how to pack Tundra, regardless of the small print. It's in his best interest to get things like packaging correct so his customers do not give him negatives, which if it was his fault the Weequay is now broken then a negative is what he should have got.
 
100% agree with Joe. I'd like to know what it said in his description that makes you think you can't neg him or at least claim back for a damaged item. The old "no refunds" trick is a fallacy and holds no water when it comes to paypal claims.

I basically knew what he wrote was to cover his ass, but took a chance, and it backfired.
The box it was in was squished in lack of a better term, with no protection whatsoever to the card or the bubble inside the box...
When I opened the box and saw this, I thought at least I can smell that new toy smell then, but the smell was almost gone, faded in transit, so no
consolation on that part :p, and a mint weequay for £30 incl. shipping isn't very satisfying...

Return this and claim your money back including postage.
He has made 2 mistakes here. 1) he has not actually described the item for sale at any point in his massively overlong "description" so he has no stand point on "item is as described" so you are ahead there. But more importantly the item is listed as...

Which means the item needs to arrive in the condition it was the day it came out of the factory. Which it didn't.
Thirdly, as Joe states, he has a responsibility to package his items correctly so that they don't get damaged in transit. Nothing exemplifies you from this duty.
 
I have also had a Palitoy Jawa MOC that came trashed from him. It was just sent loose in a shoe box, no bubble wrap, no paper...... The bubble was obliterated :roll:

Put in a paypal claim, you will almost certainly get your money back :wink:

I have already made positive feedback though, isn't it too late for a paypal claim/refund now?
 
I don't think the feedback is relevant to a paypal claim so you should be fine. If he brings it up say you left it by mistake/thought it was for something else. Whatever.
