Can the dealer do that? I'm pretty sure they can't. You need to talk to the citizens advice beauro or trading standards. The deposit is only really to stop him selling the car to someone else. If you have changed your mind he has to give you your money back I'm sure.

Hi Mr S, sadly a deposit is totally non refundable, spoke to citizens advice and they confirm unless he refuses to sell me the car I have no legal recourse, he has smelled blood and put my feet to to the coals so to speak.

Absolutely sickening Mate - sorry to hear your news.

Re the car, if the dealer insists on being a complete scroat and if you do still need a new car, is there a chance he'll swap your deposit onto a cheaper vehicle? Other than that is the dealer the owner of the garage or does he have a boss that you could take your case to? If these possibilities fail you may have to weigh up whether you'd lose more by purchasing the vehicle and selling straight away or simply forfeiting your deposit.

It's bollocks luck any which way but chin up; it may be a bit **** now but it'll get better!
 
I'd certainly go to the press and to social media - bit of a name and shame of the garage might change their mind a bit
 
Mate that's rally crap, such a bloody shame.

As Iain says though as a last resort, you can advise that you will name and shame from a " moral" point of view.

Did you sign for the vehicle on the dealers premises.

If you did then the dealer is within his rights to keep the deposit, having said that you can put it in writing to him that you had changed your mind due to unforeseen circumstances ( I.e. You didn't know you were going to be made redundant) and that you will use free legal services to fight for your deposit as you need it for your family due to being made redundant,me specially so near to Christmas, and that a local journalist you know has asked you for the story as they are doing a piece on unscrupulous traders.

Put it in writing first, and ask diplomatically for him to reason with you, also depending on the amount of the deposit ask him to part refund the deposit for honourable reasons

If this fails then ramp up the pressure re journalists etc

But keep at it and you will probably get your deposit back


IF YOU SIGNED FOR THE VEHICLE OFF THE DEALERS PREMISES ( I.e. He brought it to your house go show you, or you gave deposit over the phone
You then have cooling off period and a right to your deposit back

Hi Guys wow many thanks for all the support it really means a lot, I spoke to citizens advice as I had already paid for the car in full and to let me out of the Deal he wanted to keep the deposit and he can totally do that I am the one who has to suck it up as a deposit is 100% non refundable, I was originally going to cancel the purchase and buy a cheaper car but after thinking about it if I lose the £1000 deposit and then buy a banger to run round in plus as the insurance company have taken my courtesy vehicle off me I have no wheels I would need to spend nearly £100 to rent a car for a few days for work and finding a banger in the end I will lose more than if I simply bought the car and ran it for a year so that's what I did.
 
Many thanks Liam, I have thought about it today and if I am totally honest I think this could be a very good thing, and that's how I'm going to choose to see it, this forum and it's membership rule, Many thanks for all the positive comments it's meant a lot to me!
