Help Needed : Ebay Fake Goods !

My wife recently purchased something on Ebay that turned out to be fake... we requested a refund and the seller emailed to say they had no idea (usual deny it and cover it up story) and said we could have a refund if the item was returned.
She then CANCELLED the original refund that we requested and now PayPal are asking us to give them confirmation of the item being returned or close the dispute.

Now since this has happened the sellers account has become "no longer registered" and to be honest, even if I send the item back with tracking to prove I did, how the hell do I know I will get my refund?

Can someone help answer these questions?

1.) If I provide tracking info will PAYPAL refund me? or will they try and take funds from the seller (if so what happens if they have no paypal funds??)

2.) Is the tracking code (confirmation) good enough to get the ball rolling or does the seller have to actually receive the item and let Paypal know it arrived?

I just basically want to find out the best course of action, this wasn't cheap and I want my money back :(

sorry to say it sounds like you probably wont get anything back from paypal as if the ebay account is closed, they've probably cleaned out their paypal balance too :(

Did you use a credit card to pay via Paypal? I'd go straight to a chargeback if they will cover it.
I don't have any credit cards, I used my bank card (Account card)

Same principal? Call the bank?

I would file a paypal claim for item not as described. I would not return anything until I had my full refund secured. He may not be a registered user on the bay, but he still has a paypal account.

Thats what we did Todd and the next course of action is either put the tracking code into the dispute console or close the dispute....!!!

Think I might call them tomorrow as I think I will probably get stung twice on this and the seller will get the item back and keep my money.

Any other thoughts welcome or if you have been in the same situation what happens when you send the item and give paypal the proof you sent it?
I dont mind sending it back but I don't want to wait till they receive it till I get my money back I want paypal to refund me asap!!!

English seller

We read into everything we could and it says that although paypal will do what they can do get the funds from the seller , if there is not enough money in the paypal account to cover it they might not be able to recover the full amount..what a crock of ****.

On top of that its going to cost us double to send it back as its hard to get a signed for/tracked service in Romania as there aren't so many companies offering that service to keep the price down for competition.

GRRRRR

Please keep the suggestions coming though guys.
Really helps

When you have a paypal account with the funding coming from a bank, is there not supposed to be a back up source?

Lol Bez I think If I get stuffed for the refund I might take you up on that!
Still at a loss on what to do, most people think its unlikely I will get the money back now the member is no longer registered...

where abouts is the seller ? i think you will get a refund once you put the tracking code in

No, they're going to ask for proof of delivery. I've been there. The online tracking wasn't updated and the seller denied ever receiving it, so I started an inquiry with my postal service. Thankfully they came through and PayPal refunded.

Thanks for that capetown, that is how I thought it would pan out..
Pretty crap.

I think we are going to just let it go, pretty **** that people get away with your money but I would rather not send it back and let someone else get scammed with the same product.
