Ebay Scammer

Been a while since I got ****ed on Ebay...but here ya go...........does this auction look like you might get the box with the items

I received a handful of the candy heads...no box!!!!!!!!

Here is our discussion thus far......

Dear johnp721,

You can not put a picture of the box up there at that price (The heads are worth about a buck a piece) and expect someone to know it does not come in the box. Your description did not state that the box was there to show what these would have came in and it is the only picture on your auction. I have already placed a paypal claim in the event that there is no resolution. I will proceed with that claim if we can not reach a return and leave feedback accordingly.

I guess you are putting words in the discription that you want to but I do not have in my discription about a box being issued with the 4 head in the set and I made sure that i put in that there is no candy in the heads.There are 36 heads in the box and I have the 4 series heads listed in the discription and not a full unopened box of heads.The top of the box shows the 4 different heads and that is why i put that picture in on my discription as to show the 4 heads what sthey look like.

The item you have pictured show's that the item is in the original box. All I received was a few of the candy heads. I would have expected to receive this item as shown and I did not. I am very dissatisfied with the items you sent me as they are not the item you had listed. I can return these for a full refund plus my shipping expenses for a full refund. Possibly my fault......hims just used it to show what it might look like packaged..........Paypal claim time.

Am I wrong or will paypal just refund me due to this idiot's picture of the item???

I would say seller is at fault. If it's in the picture and the listing doesn't say it's not included, you'd expect to get it. Would think paypal would side with you on this one.

Looking at his feedback, you have to feel a bit sorry for him with the neg he did get ! Still you can always add another

He's right in that he did not state the item would be in a box [with his intentionally misleading description] but he is still ultimately in error as the picture on your sale must be of the item you are selling OR you must state that you are using a stock picture. To do otherwise is fraudulent. These are the rules of ebay. I would put in a claim for a refund with ebay without any further communication with the seller. You're wasting your breath. ebay either will or wont refund you but you'll get no more sense out of him.
If ebay do find in your favour [and there's a 95% chance they will] you are also likely to get to keep the goods.

I actually do not think he is a scammer. Just ignorant, and after looking at the auction more thinking at his level...I guess he did say "four" over and over again, I just thought it was the box with only four of them.....still getting my money back.

Im sure you will win this one, its pictured with a box and unless he states the box isnt included, its a not as displayed/described case.

Open & shut case IMO m8, you should win this one, as others have already said, if its in the photo it should be included in the sale unless otherwise clearly stated & that's the only photo, so you would assume that is what you will get IMO

It is best when they ignore it. ebay finds in your favour once the allotted time has passed and he loses money and his item. Thing is, if he'd offered you a partial right off the bat and apologised, you likely would have agreed thus saving him losing all the money for the item and getting a neg. :roll:

Yeah...Just thanked him for all his cooperation in speeding up the refund process and the free goodies he shipped me for free. :lol:
