Devious ebay seller,can you spot the undisclosed damage?

Hi lads,

I spotted a Lobot MOC that i needed for my focus on Ebay USA & Iain kindly bought it for me & posted it on.The seller said that the only issue was a slight bubble ding so after looking at it closely,i went ahead & bought it.When Iain received it,he give the bubble a quick onceover & posted it on to me! 8)

When i received it,the damage stuck out like a sore thumb so here is a pic,can you spot it??? :lol:

I will reveal the damage (and the seller) later! :D

Someone has printed off a little 'patch' and glued it on to the cardback to hide damage? File this one under 'bad restoration', to tell the truth I would rather have a damaged card than that. I wonder if the patch could be removed?

Have you decided to do a straight return or request a partial refund?

Matt,i can't return it as its from the USA & i don't want to fork out for return postage plus Iain bought it for me.I'm gonna message the seller & ask him why the repair wasn't disclosed instead of him just saying "view photos very carefully before committing to purchase or ask questions" :roll:
 
Good luck with it. If you have a bad buy on Ebay it's always a good idea to give the seller a 'make it better' suggestion (I usually give them the choice of a full refund and return, or a partial refund and non return) rather than simply butting heads and being confrontational. I appreciate this particular transaction is a tricky one though as you had a middle man - good luck I hope it works out for you and the seller makes ammends.

Well that's definitely someone trying to pull a fast one :eek: I've had several miss-listed items sent to me recently (far too many actually), and every time I've contacted the seller to say that the item was not as described the seller has offered a part refund. Hopefully you'll get the same response although I'd keep it friendly to begin with and see what the response is. The only slightly worrying thing with this seller is that they really are trying it on so you might not get the response you should.

Real shame and best of luck getting some money back on it.

Here is my message that i sent to the seller which i thought was more than reasonable!

Hi,

A friend of mine bought your Lobot 48back MOC on my behalf as i live in the UK & on receiving it,there has been a repair to the card just above the bubble where another piece of cardback has been cut & stuck on likely to cover a rip/tear.I was wondering why this repair was not disclosed in the description as i would never have bought it if i had known & would you be prepared to offer a partial refund in regards to the damage?

Your help with this matter would be greatly appreciated,

As a reputable eBay seller, I disclose all information that is known to every single item that I sell. I inspected the LOBOT card and action figure that was purchased and described everything I observed and knew about the item. I do not deceive or mislead any potential buyer, never did never will. I do not know why this is barely being brought to my attention now, when this item was purchased some time ago. And I also put in my disclaimer that all items are purchased in 'as is' condition, I do not give refunds or exchanges. Whatever defect that a person observes is not something I was aware of, I do not intentionally sell defected merchandise, that is unethical and I am not unethical.
 
There is no such thing as no refunds on eBay, you can force it through if you want. Clearly he is not going to give you a partial refund. All or nothing. Sorry man!! :cry:

Wrighty,i know it would come under a "not as described" claim but as Iain bought it for me,he would have to mess about dealing with it & he's busy enough as it is!

I'm just gonna post this incident on the watch out sections on RS & TIG & warn people of this guys shenanigans.The seller is: designer251975
 
That response you got from the seller is just typical, he might as well have not replied. You could still report him to ebay but whats the point.

As you said said report it on the sellers to avoid thread and move on. :cry:
 
Really sorry top here the response you had although it's hardly surprising from the seller after the way it was listed.

If it was me I wouldn't be happy with the reply and say that even though he may not have noticed the repair ( remember that Iain didn't spot it either), it's quite obvious (you should attach a clear picture of the area in question). I would mention that you found it quite strange that there pictures in the listing aren't very clear and that it's impossible to see this repair in their images. If they are as reputable a seller as they claim they they should review all this information and come up with some solution. I would also say that you though it fair to give them a second chance to make this situation right or you will be forced to leave them the feedback that is only fair to give with what you ended up receiving. You could even mention that this will be also bought up on other vintage Star Wars forums as you feel that people should be made aware so as not to also get caught out.

I'm not sure if any of that will help or if in fact you even want to go down this route but I'd not be happy with the tone of their reply and that as a buyer you do have rights. The item was not listed in the condition it should it actually is and if the pictures aren't clear enough to tell then it's the seller who's to blame and not the buyer. The seller also clearly didn't read your message to them properly or they wouldn't have asked about why the delay was with getting back to them. Ebay can really suck at times when things go wrong but the good still outweigh the bad I find.

To be fair to Iain he did literally check the bubble and then repackage it :wink:

No offence intended as I'm sure you know and from the response from the seller ( and blurry pictures in their listing), I'm pretty sure they already knew all about the damage. Hard to say really as they are apparently reputable! :D
