Most of you know that I have been having an issue with a seller on RS regarding some repro weapons that he sent to me. I still actually believe that he genuinely sent them out thinking they were real and had been duped himself. However, things have got nastier and nastier until I got am email from him today basically threatening to sue me !

What gets me is not the value of the weapons that he short changed me on, but his accusations that I must have switched the weapons.

I did not ask for extra pictures of the figures as I was confident that dealing with a member of the board that there should be no trouble. As you can see in his pictures, there are no weapons - more on this shortly.

Basically, I am happy providing that they all are in good shape (stiffish limbs + very minimal paint loss) and that they all have their correct, vintage weapons - ie the last 17 have black endor and palace blasters

I started going through this and noted that the Ewok Bows were both the wrong colour. I checked a few more of them and found 4-5 more repro weapons. There was also no black blaster for Luke Stormie, no Paploo Staff and no Black Palace Blaster for Luke Poncho.

Therefore I had not received what had been advertised. I made contact with the seller to tell him this and that is where my problems have started. Basically this can all be found in the following thread. The seller I believe bought these in good faith but does not accept that either a)these are repros or b)that I did not switch the ones he sent me for repros. He did add some extra figures to the deal (although didn't make any effort to tell me this - however I have done some rough workings out on the value of these figures and they don't make up for what is missing/repro)

In addition to the repro weapons, there were a large number of Blue Smuggler and Stormtrooper Blasters rather than Blue Black ones. The Warok sent was packed with a Lumat Quiver and there was an additional Repro Stormtrooper Blaster. Peter did offer to swap over the blasters for Blue/Black ones that he had, however denied that he had send me repro weapons. I posted pictures on the boards and evidence was pretty conclusive that these were repro weapons.

I did not hear back from Peter in over a week so decided to post this on here

Amazingly, I then got an email ! However, after this had dragged on for a couple of weeks I suggested to Peter that we could end the issue with me sending back the blasters for replacement together with the weapons that I considered repro and that he could send me an additional 12 blasters to cover them - this way he was not out of pocket, had his weapons back and I was happy to put the deal to bed.

This, however is the final email I have received from him tonight

"The value of the trilogo Fett is £60 upwards so covers the cost of what you claim to have spent... interestingly you have a thread selling vintage weapons as well as a thread requesting ewok weapons BEFORE our deal...
If you defame me in anyway I will sue you... claiming damages for loss of potential earnings from the sale of the rest of my collection... far more than you already paid. I advice you to refrain from any further harrassing, threatening or accusing emails or the perpetuation of any threads regarding this matter.
If I receive any further communications I will be contacting the police and having a harassment warning issued to you.
This deal is concluded."


I believe that Peter is suggesting that I switched the weapons. I have about 20-30 people on the SWFUK site that would be happy to give me a character reference - http://www.starwarsforum.co.uk/viewtopic.php?f=1&t=13272

I have in no way harassed Peter, other than asking for a resolution to this problem. The only 'threats' I have made are that I would post the information about this transaction on the boards. Peter's wife has been in hospital recently and he has constantly stated that this is why communication has been bad. On the majority of the emails I have sent to Peter I have asked about his wife's health and have accepted his reasons as to why he has not been able to communicate.

As for his threat to sue me - I suggest that he goes right ahead and does that because he will lose - and will waste a lot more money in doing so that he would have done in putting this deal right in the first place.

To be honest Liam, it just pisses me off - it is not a lot of money but I would expect better from a fellow collector. In the past I have unknowingly sent out repro weapons - but as soon as someone has told me then I have replaced them straight away.

Even tho i dont know you personally Iain im backing my fellow SWFUKer :)

Cheers mate - he's a Brit actually but I don't see this getting resolved - would be interested to see how he plans to sue me tho :lol:
 
It's amazing the holes some people dig themselves in to just because they can't admit they're in the wrong. Threatening to sue over a few quids worth of toys, WTF!? :lol:

We know that you would never ever pull a stunt on anyone.
I'm not sure how this can ever be remedied. So don't wait for an answer.
As a seller, i reckon he's lost all credibility, as a seller and buyer you've lost none.

I'm sure that with your dominating great reputation both on the forums and eBay you'll still do ok out of the transaction.

As i said mate, within 2 weeks you will be a Daddy. Stuff like this, whilst as disappointing as supporting Bristol Rovers; is insignificant next to the power of parenthood!
p.s. If you need to offload those repros and ensure that they don't return to circulation Leo will have them :wink:
 
Well the first thing I do before buying from someone is check their post history. None of his previous posts would have made me confident in sending a cheque or buying without pictures of everything.
Unfortunately this is going to end up as a he said/she said bunch of polony.
It sucks to see you get screwed over. The fact that he sent 'extras' does indicate he knew he was in the wrong.

You are right - I guess that I always set out to give people benefit of the doubt, especially fellow collectors - it is just a shame that incidents like this force you into thinking that everyone is out to scam you

Thanks - and as Jez says - this is far more important than any silly bits of plastic (whether they float or not!)

Absolutely. And it's VERY applicable to this situation.

On the one hand he is selling up because he needs funds and then he is threatening to sue, good luck getting legal aid for that you gimp :lol:

I know how this **** can rub you up the wrong way 1st hand but the guy is not worth stressing about, I would just have some fun with it :D
 
Iain firstly mate the guy can not get the Police to issue you with an Harassment warning.
The reason being it does not fall under the constraints of the Harassment act at this time.

Harassment is causing another person Harassment,alarm and distress by your actions, it was basically brought in to stop stalking. The offender also needs to be aware that their actions could be construed as Harassment.

Also as the guy has been communicating with you its not Harassment, its a dispute between two parties and is purely a civil matter not a criminal matter. As long as no threats to cause the alarm and distress have been made, then,again its civil.

The fact that he has NOW said not too contact him demonstrates that he can not be reasoned with, and that he can not act like a mature adult.
I would not bother communicating with him now mate.
As soon as the guy has said not to contact him, and you carry on, in the end he could go down the harassment warning route, which would be bollocks and a waste of Police time.

As far as i'm concerned this guy has shot him self in the foot because of his shear pigheaded attidude, i certainly would not want to deal with a person who is not ready to listen and act in a mature and reasonable manner.

Ive dealt with so many unreasonable idiots in the past ,as i'm sure many on this forum have, no matter how you try to deal with it , these people are tottally blind to the fact that they could be wrong and have made an honest mistake.

You might as well as hit your head against a brick wall pal.
