I've bought something on Ebay that upon arrival (from Croatia) is clearly fake. I bought some trainers on Ebay a couple of years ago that turned out to be fake, and as soon as i opened the case Paypal closed it in the sellers favour stating that they cannot verify whether items are fake or not! So I don't want this to happen again.

So what is the best thing to do. Open a paypal dispute? Go straight to my credit card company and get the payment reversed? It was quite expensive (over £100)

Wouldn't it help if you supplied pics to paypal?

Last time they wouldn't even entertain the claim. It was a flat no, we can't distinguish fakes.

I bought some fake stuff from the UK a while back, made a claim with PP, but got the same answer,
didn't try to prove it any further though, I'm just a lazy ****, and the items worked which was a small consolation. :p
Just glad it wasn't too costly.
Sorry I can't help mate, good luck!

I wouldn't go down the fake route as it is hard to prove - just claim they are not as descirbed and that you want a refund - normally paypal will find in your favour and ask you to return them - you will be out postage return costs - and will have to send them international signed for - but you will get your original money & postage back

Yeah that's what I'm worried about. I don't want to open a claim I have no chance of winning.

I bought a fake moc a while back and the only way PayPal would refund me was by sending it to ukg and getting an email on headed paper. I don't know what item you got Ed, but it's probably better to open a not as described case.
If you say something is fake, they need a letter or email from a professional company, which I guess could take ages, depending on who you have to get proof from.
Good luck.

It was a Sega Mega Drive (people will fake anything!)

The **** is still selling them, I'd appreciate it if anybody else could report it as a fake to stop him ripping other people off.

Have reported it with both of my accounts tho i have found out recently that ebay tend not to give much of a **** with fakes items and stuff like that unless the official owner of said material is the one reporting it. They like to keep things selling. There are literally 100s of thousands of fakes on ebay. You think they don't know??
My advice would be to contact Sega themselves and report the item. I have a feeling they will take the situation a little more seriously. They may not, but it's your best bet if you wanna stop this guy.

if you paid with your credit card you are safe in the knowledge that you will get your money back edd, personally i would go with paypal dispute, get a LETTER from a games shop on headed paper with conformation its a fake and add that to your case, they then cannot refuse it.

if the guy asks you to post it back you refuse as its actually illegal to mail counterfeit items :)

IF paypal run in their favour (they wont) take it up with your CC company, they are usually brilliant to deal with.

Andy

Well for a change things worked out and I got my refund, I even get to keep it. They still haven't banned the **** or stopped him selling more of them though! So if anybody fancies a free fake Mega Drive, buy one and then open a dispute. Teach the guy a lesson ;)

So how did you end up going about it Edd?
I've had to do this a few times with fake stuff, & as Andy said, i've always sent in some proof immediately (in the form of a letter on headed paper from someone in the know.

btw...does the fake Megadrive work?

Yes it works fine, it's a clone console and they're quite common in Asia. They're quite hard to tell apart from the real thing, his photos in the auction are very clever not to show any of the tell tale signs.

I opened a dispute listing the reason as counterfeit. The seller flat refused to refund me and said I bought what was in the photo. I think his lack of help is the main reason I won. After 8 days had passed, I escalated the claim and politely said that Buyer Protection should cover me for fake items, if it doesn't I'll be doing a credit card chargeback. I got a 'courtesy refund' from Paypal within an hour, no questions asked and no proof necessary.

I may just do that!
Good news Edd.

If anybody does buy one, here's the thread I posted in my dispute where I asked some 'experts' to confirm it was fake:

Interesting window into a different collector's world that thread. Not too different from our own at the end of the day really. Bloody fakes!
