asked the seller for a refund and this is his response

"Either you have a really bad sense of humour or something else must be wrong.
The figure was mint, you are talking rubbish and the mods have been informed as
To what you are trying to pull here"

why is it that I'm in the wrong?

no return was specified and i paid as gift. im just angry at being accused of trying to pull something?
great paintwork but the figure wouldn't stand up even with a stand. is this normal for tri fetts? paid £75.

If the figure was not described as having very loose limbs yet it can't stand unaided and it's legs and arms move whenever your next door neighbour farts then yes I would have asked for a refund too. Loose limbs were (and obviously still are) a pain in the backside, especially when you aren't expecting them to be loose.

Out of interest, where did you buy it from? The seller mentioned "mods" so I'm guessing it's either FB or the forum. I don't think any of us have received any complaints about this though?

You bought it from a seller on here??!

Loose limbs is an aspect of the figure that absolutely should be mentioned in the write up.

Never pay by gift if you've never dealt them before - EVER. Even if it is a board member.

I would give them one more opportunity to sort it out before contacting admins.

Surprised it's one of the chaps on here, unless it's a newb...

Ok firstly, there is a guideline about forum gift payments: http://starwarsforum.co.uk/viewtopic.php?f=4&t=23184

If the seller requested you pay him as a gift then he's in the wrong for starters.

Secondly, if the seller is being as unhelpful and rude as that PM you quoted makes him look then I think you should probably out him so this can be resolved in public.

Providing you alerted the seller to the loose limb issue within a reasonable amount of time and you were unaware of the problem before you received it then he really shouldn't refuse you a refund.

It's kinda basic selling stuff when you describe something.. Maybe we need to write a manual? "Does figure stand up unaided? Y or N.. If N make sure to inform potential buyer.."

A "Mint" description doesn't only refer to paintwork, it covers the figure as a whole. Loose limbs should be specified as such.

Whatever resolution you reach with the seller, they should be outed anyway IMO, then its easier for other forum members to decide if they want to deal with the seller in the future after your issue has been resolved. That's why we use feedback.

Peace

bought the figure off Bootyhunter.

That's surprising, I've dealt with him before and everything went great.

has been a few weeks but iv been busy.

Ok, now I can see where the problem is. Sadly you can't wait "a few weeks" to tell someone you aren't happy with something you've bought from them..we are collectors after all and not shops like Argos with 14 day refund policies.

How long is a "few weeks" exactly? 2? 3? more? Busy or not if you are buying you must inspect your purchases as soon as you get them just in case there is a problem..I have a feeling there is a lot more to this story than I first thought!

been about 5 weeks i know a lot of time has passed but i didn't get chance to look at the figure straight away. i have honestly been really busy. there's is nothing more to this transaction. im an honest buyer/seller. been collecting since about 2006. i don't have access to a camera at the min. ill try do a video and show how loose the limbs are.

Often peoples responses to things can be worse than what they actually did. Admitting you've made a mistake or being courteous about what's happened goes a long way. I hope it gets sorted, give him a chance to respond :)

I'll be honest, I was 100% on your side up until you mentioned it had been 5 weeks since you received the figure! I don't want to be funny but I can't imagine many sellers here offering you a refund that long after the item was received..sorry!

No doubt that the loose limbs should have been mentioned by BH and the paypal gift payment shouldn't have been requested (if it was him that asked for it) but at the same time you also have a duty as a buyer to check what you've received is what you were expecting..

Hopefully once he sees this/gets your email you can come to some kind of an agreement and if not - lesson to both of you to check what you are selling and what you are buying I guess? :|

Is this the fett in question...

I don't know of any retailers that let you use a product for 5 weeks then return it for a full refund, So to me, it is a bit unreasonable to expect a private seller to offer such a service on a used item.
I hope you can work out some sort of resolution with the seller, but I would certainly take this opportunity to learn from the mistake that it is not acceptable to wait so long before raising an issue with a transaction.

Scroll to the top and it is an unpainted dart in bootyhunters post.

I have to agree with the majority here, yes the seller should have mentioned it had floppy limbs. But after 5 weeks I'd say it's a little too last to complain, sorry.

I was totally on your side until you said a 'few' weeks. Five weeks takes the pee to be quite honest. It should have been disclosed in the description for sure, but you should have raised this immediately and you might well have got a better response from the seller.

I think under the circumstances a partial refund of £15 is fair and would be a show of goodwill from the seller. If it was an immediate complaint then certainly a full refund would have been the only course. Five weeks is a long time in this game, money is spent, people move on. I think its childish to expect people to believe you have been that busy for 5 weeks you couldnt check a purchase and unfair to expect him to 'buy it back' after all this time. It should have been dealt with immediately.
