Damage to new purchase

Hi all

I noticed a threat from Iain about a damaged card. I have a similar issue .

I purchase a 21 back Sandperson which arrived this morning - It arrived seemingly well packaged, however upon opening it the seller had wrapped it in a couple of laayer's of stiff cardboard. The figue itself was wrapped in bubble wrap. I did think upon openeing that it was liable to crushing in its centre.

As you can see from the pic the bubble has crushed against the sandpersons eye.
I contacted the seller who was cival about it, but did not state whether or not the damage was there before he posted it (no mention of it in the listing, difficult to see in the pictures) he also states in his opinion it was securely packaged. mmmm

I didnt request insurance (although I did send a message requesting to please package appropriately) nor was it offered - what do you reckon??

Hi mate, firstly sorry too hear about this.

Ok there are mixed opinions about damage during postl but my thoughts are this, always study pictures well on eBay, if the pics arnt clear ask them too email you some, as people can be very clever how they list things and also the pics they put up.

Me personally if I sold an item too somebody and it got damaged I would offer a full refund or a partial one, its **** when something gets damaged after you have paid good money for it, and it's also **** or the seller in some cases, so I would ask for a refund mate, or atleast some money back, if he doesn't want too know then in my views he's not a good seller anyway.

What I did when this happened too me mate was I asked for a part refund which I felt would make up the money which I had lost on the value of the item, just a thought mate, then atleast you won't feel you have lost out too much, having said that if the Moc will bother you not looking as good as it did, then try too get a full refund mate, I'm like it with boxed stuff, tears on boxes put me off as do EV-9's with only one leg :D
 
Put in a claim with paypal for "goods not as described" or "damaged in transit"

Be honest and say it as it is and that you feel let down,my guess is paypal will go on your side..

If he was a decent seller then you would of had a positive reply from him already...

That's such a shame man! I'd agree with the above and try and resolve it with the seller first, then try PayPal.

Assuming this was through eBay. If so, is the eBay listing still up? Because you could do that 'trick' to enlarge the picture maybe? (Go to the listing, right click on the picture and get its web address and change the number at the end from "_12.JPG" to "_10.JPG"). That'd make the picture the same size it was when it was uploaded at least and may show whether the damage was present.

Also, if PayPal don't go in your favour, if you paid via PayPal using your credit card, you can ask your credit card provider to do a 'charge back' as the goods were not as described, but hopefully that won't be necessary! (But you have around 2 or 3 months from the date you receive this to do it).

You have 2 options.....

1. Ask the seller for a full refund and return the item.

2. Keep the item and try to work out a partial refund deal.

If you fail to sort the problem out, log a claim with paypal they should act in your favour and give you your money back.
 
Paypal does not recognize the packaging damaged as being an issue. They look at the item contained within in it. In other words do not claim the damage to the bubble as you will not win.

OK, I'm going to play Devils advocate here.....I'm a bit disappointed at how quick some people are saying " just log a claim, not as described" etc....both as a buyer and seller on here and eBay it's unfortunate if damage happens in transit. But to automatically say "oh it's not as described" is just wrong imo.....that's just me

I have only just been contacted by a buyer with this very same issue....I would be interested to hear lads opinions, so....if an item is dispatched on time, postage included, no insurance, securely packaged as possible, star case/bubble wrap etc... how is the seller responsible for full refunds or partial refunds in these cases......I appreciate the good will factor and that but why should they be out of pocket??

I have a card on the way that if it's damaged its my hard luck as I never looked for insurance etc.....yes I asked specifically for decent protection on the card, but if it's damaged I don't feel I have an instant right to monatery recourse....

in a blatant case of bad packaging maybe it's more black and white.....saying all that though as most if the lads have said I would talk to the seller and ask about the possibility that gr damage wad prior to postage

I agree with everything you say. If I have packaged it correctly and you did not want it insured...it's your risk. In the case of a friend or member I have dealt with before...I may actually meet them halfway, but again to me it's the buyers risk with no insurance, but from an ebay-paypal perspective...it is all the sellers fault..so it depends on the who, how and where factor.
 
I agree with Jeff. These things are never black and white. And as Chaz mentioned, I have had a similar problem and am actually the one that sent out the item. Luckily for me the buyer has been very reasonable and we have decided that he will sell it on Ebay and we will split the difference in terms of the loss on the original price.

I packaged up this item very well and it is just a shame that the damage occured. I would like to think that if any of the guys on here had sent me something well packaged that I would also be able to reach an agreement with them rather than go down the paypal claim route (which always seems to favout the buyer)

There is a thread currently on RS which touches on this issue as well and I am sorry to see so many people heading down the path that it is always down to the seller to make sure the item arrives in perfect condition - unless it is hand delivered this is never going to be the case as we have to entrust these items, which are brittle at the best of times, to one of a number of carrier services. However well we pack these items, damage can occur and items can get lost. I would just like to hope that as fellow collectors we are able to work together rather than go son the Ebay/Paypal route.
 
Hit it on the head there. I have read the RS thread you are talking about and most of the posts basically say the seller is in the wrong and should always insure the package and is an ass if he does not. IMO, After you have paid me for an item...you are now the owner. I pack it just like I would like to have something packed that is sent to me. If you choose not to have it insured.....that is all on you. That is not to say I would not feel for someone or even come to some understanding, but to fully place it back on me.....well I would think the buyer to be in the wrong.

That does not mean the OP should take it in the ass...but once again..it all depends on the "Who, how" thing.

On a side note: I have not commented in the RS thread due to me having a differing opinion and well...I will get banned. :lol:
 
My rationale for suggesting a PayPal claim was only in case something can't be agreed with the seller, but was primarily based on this statement, which suggested the listing was misleading.

Luckily when selling on eBay, I have never had any problems with claims (I don't sell enough probably!).

That said, if sellers (or buyers) feel they are being penalised by the PayPal claims process, you should definitely just put in a formal complaint and suggest you'd refer PayPal to the Financial Ombudsman (in the UK at least) if a satisfactory outcome is not reached. PayPal may just cough up and pay you back regardless to save the hassle!
 
My argument is exactly the same,the seller isn't open to negotiate...

In that case he is a tit and deserves a claim against him...end of argument

However most guys on here this would never be an issue because we all know how to "liaise"

eBay is a minefield and for every good seller,there are twenty dins out there full of bullshit..

Nobody is suggesting "open a claim" every time we don't get our way when buying but I do suggest it every time if the seller is a cock...

Thanks for your comments guys - Jeff - I feel the same really, the guy has been decent about it (it could have been better packaged, but **** happens) I did send a message requesting it was secure in transit - I have had £50 figures sent in a jiffy bag!! :roll: )

I'm keeping him anyway just a pity though (with this and my only just discovered fake stormie - see other thread, its not been my week friends!! :lol: )

Got to agree with Jeff here. I've bought things in the past and they've arrived damage even though they've been securely packaged they've arrived damaged. Message the seller, and then lodge a complaint with the Royal Mail (or whoever the carrier was) to claim a partial refund.
 
I think as a seller you shouldnt even consider offering non-insured post, its just common sense, its very nice if its cheap postage but if it arrives damaged the seller loses out all the time.

in this case i would just request to send it back for a refund, or he may just agree on a partial refund, i wouldnt open a case though, its always best to have a discussion about it. you will probably find you come to an agreement pretty quickly
