I sold something of low value (£3) last Sunday, he pays late Monday and I post 2nd class lunchtime on Tuesday. This Sunday I get a case opened and refund request due to non delivery. I had to wait 8 days to open a case on someone who never shipped but he can open a case 6 days after he paid, doesn't seem right? He claims he has checked with the post office and they don't have it either

Royal Mail state they aim to delivery within 3 working days, so should eBay really allow someone to open a case so soon (have I shot myself in the foot by 'marking as dispatched' on the way back from the post office??) I can't do anything with Royal Mail until 10 days have passed, by which time I will probably have paid him back. In future should I mark it as dispatched a day or so later to give myself some extra time for this sort of thing?

Bit annoyed with myself as the receipt I got from the post office only shows the stamp price (I was a bit preoccupied by the other item I was shipping to the US). Also that despite him being 150 miles away he lives 4 miles away from my sister and she works with a guy on the same street as him - proves its a small world!

That's a shame. It's tough with low value items as charging sign for postage would cost more than the item. Sadly, some folks target such things, knowing they wouldn't be sent sign for. All you can do is refund this person and claim back through Royal mail. Ebay will side with them as there's no proof of delivery, even if your gut tells you they've probably received it.

Being honest I open a not received case the day after eBay says I should have the item, not to get free stuff but to cover my own arse if the seller doesn't post it. As soon as I receive the item I close the case and leave positive feedback.

I think I must be a bit soft as a buyer, only opened one case so far - and some of time taken (and packaging) for some things I've bought have been very poor!

Just feel trapped between eBay counting down and unable to open a case with Royal Mail for at least another 3 days (in the case of a delayed item)

Probably didn't help that I had probably had a beer too many last night and in a right moany mood today...

I'll try to explain it from my point of view.

You have 30 days from the day the item should have arrived to submit an unreceived item case.

I'd be really surprised and disappointed if someone did that to me without having the courtesy of contacting me first, that quickly after posting. In fact I've had people chase before the 2-3 day window and even one arsehole, Evan Grandi, well known on the FB Pages, aggressively demand a refund 1-2 days after the allotted time period, despite proof of purchase, and then leave me negative feedback despite the fact that I had already refunded him, against Royal Mail recommendation The item turned up a couple of days later and he then pretended someone else signed for it. Anyway I digress. There have been a number of occasions where one of my items has turned up outside of the specified timeframe for a Royal Mail delivery. The problem is if you refund the money and the item then turns up, the buyer has no obligation to re-pay for the item and the seller has no rights to reclaim this money through eBay - you are relying solely on honesty and not every buyer is as honest as you Carl.

Furthermore in order for an item to be considered lost by a Royal Mail it has to be 10 working days after the date it should have been delivered (ie 13 working days after you posted it) which would fall outside of a case opened on the 4th working day (as eBay requires it to be resolved in 7 days before taking action against you).

Royal Mail advise you to not refund money before that time as if the item was delivered before those 10 days elapsed you would not be able to claim compensation through them. That would leave you screwed if the item you had posted was a MOC for example and incredibly valuable.

I think that is what is winding me up - must have sent 100 odd things over the last 18 months and no issues, first time I don't get a proof of postage as a minimum and the buyer is demanding a refund after 3 working days.

Just feel he has seen the stamp and thought he'd have a go - obviously I have zero proof

Yep, if they have posted it that's fine, they will have proof or the item will arrive. If they haven't bothered to post it it gives them a kick up the arse. If they never intended to post it I don't have to wait for a refund

I think I can use this experience to prove that Karma doesn't exist.

I sent 2 parcels that day, one to this guy and the other to a SW forum member in the US free of charge. Last time I do a good deed if this how I get rewarded!

Sorry to hear that mate. I've had cases opened agains me 3 time, twice was causer the idiots didn't pick up from the Post Office and were sent back to me, how is that not received surly they would have got a note from the postman saying its for collection. The other was a combined postage it. Left feedback for one item and the other opened a not received even though I had combined the postage cost. Turns out was still in the box in the bubble rap not bothered opening it idiot.

Looks like a few people have had issues with this guy.

Couldn't sleep last night so when through his 100% feedback, they are all as a buyer (so no way of not being 100%). All the items I looked at that he bought were around the £5 mark and out of the 180 or so feedbacks in the last 3 months, 6 people had commentated that he had opened a case straight away and hadn't responded to any messages. One guy had even done a signed for post and had to refund him.

So looks like 3% of his post goes missing in transit by these numbers, at what point do eBay look at his account and stop him doing this??

I've refunded him because it was only a matter of time before I was forced to, thinking of sending him a few parcels with the wrong postage on so he has to pay to pick them up...

there is actually a website called poopsenders who specialise in this, 100% anonymous, and you can choose between cow, elephant and various exotic flavours.... guessing someone works in a zoo... might be worth a look
