hi all i hope i have put this in the right section
i hope you can help me if i am wrong i will put my hands up and say sorry my fault but i would like to put this out there for other people to have there say and so others can learn from this
here it goes
I sold 2 could be toni specials to someone outside ebay as everyone knows about there maybe problems i did not mention it and he did not so i thort he know about them (stupid me) and was happy to pay me and i posted the items he emailed me back saying he was happy with them so i thort great but then acouple days after that he sent me a email basicaly saying he did not know about there problems did i and i said yes i did but the 1s i sold him i did not buy off his website i bought from fellow collectors (from here) so i did not mention it he then asked for a full refund so i said yes as i dont want a collector with something they are not happy with but i will have to get the money together as i already spent it on another deal. Some time passed and i was about to send him a part refund when a fellow SWFUK member said have you got the items back i said no as i am a trusting guy as some of you know full well. He said the deal sounds off and i should ask for my items back first or to send it to a thrid party so i messaged him that and he said no i need to send the money first before he returns them. after i said no you need to return them i had another email from him that said i will go through my card company to claim the money back and action fraud to get his money again i said to him i am willing to give him a full refund as soon as i have the items
so to break it down
1)sold him 2 items
2)he was happy then not
3)he wants a refund before he sends me the items
4)i want items sent back first before i give a refund like anything else
5)he has threatened to go through his card company

i can copy in the emails if this would help to make a opinon his name is B Wilkinsom has anyone dealt with him before

any help will be most welcome even if i am wrong
 
For someone not a member of the forums I would have personally mentioned the TT scandal.

However, a bit suspicious on how he finds out about them a few days later and his refund policy. Could you paypal him, take a hit on fees, then claim off paypal if all goes wrong?
 
dont send him the money, ask him for the items and then a refund, then change your card details lol so he cant charge it back.

however i doubt he will be able to charge it back unless he has proof he sent you the item back and didnt get a refund.

he is actually committing fraud if he tries to charge it back. it sounds like a scam to me, dont give in.
 
Agreed do not refund until items are returned unless he wants a part refund and to keep the figures?
 
Did he pay on his card, through PayPal? Gift or goods? Either way, his card company will need to go through PayPal, and they normally make sure you get your stuff back before a refund is made, although your money will be frozen in the meantime.

It's worse if he's paid you directly on his card, with no PayPal involvement, but not many people do that.
 
He paid through paypal as a gift. I would like to give him his money back as he is not happy that is as long as I get my 2 items back.
So PayPal will get in contact with me if he goes down that route? So paypal will not just be give him his money unless I get my items back that is all I have asked for

To be honest, I can see it from his point of view. He has been very good in paying you via gift payment - something that leaves him with little to no protection. You did not disclose the fact that you knew that these were TT and then he finds out from another source. Obviously he is pissed as he was not aware and you didn't tell him. He wants to send them back but you are refusing to give him back his money - if he does send them back to you without payment then he is out both his money and the figures - and has no recourse to get them back

It is a bit of a Mexican standoff as obviously you are now wary that if you send him the money back then you wont get the figures. Probably the best thing to do is find an intermediary that will take the money from you and will only send it on to him when you have received the figures
 
Agree with Iain, it's a very tricky situation which unfortunately you caused :(

As he paid by gift paypal most likely help him, you are worried that he won't send the figures back and he is worried that you won't refund his money once you have the figures back.

Could be or are Toni 'specials' ?
He can get a credit card payment reversed via the bank without Paypal being involved.
Maybe send him the money back for one item- he returns one item.... repeat.
 
where abouts does he live Marc , is it not worth a drive down or does any member live local to the guy and would act on your behalf ??

Ok I did offer him send me 1 then I will send money and then we do the same on another day when I get paid do the same.
I have also surgested third party gets involved we send them cash and items
He lives in Newcastle and I am in Bristol
If anyone would like to act as a third party I will be very greatfull as i would like this resolved soon as possible as fairly as possible if anyone would be willing to do this then I will pass this on

Hi mate - I am happy to act as the third party if needed - you can point him at my eBay page for references if you like (to be honest there is every chance I have sold to him in the past :lol: )
 
Hi everyone

I am the person who purchased the 2 figures from marc along with paying a deposit for another figure. At the time I was not aware of the Toytoni issue and Marc never mentioned this in the ebay items descriptions. If he had I would not have purchased them although I fully appreciate that to many collectors the Toytoni issue will not be a problem.

This was my first purchase of vintage figures since selling my collection in 2005, and i was out of the loop in regards to how things had changed in the collecting market, particularly having read some of the horror stories on this site abount dishonest buyers and sellers.

I sent payment as gift and it was not until after I received the figures that I was made aware of the Toytoni issue. At this point I contacted Marc to inform him of what i had been told and asked for a refund. Marc explained the situation and promised to send me a refund although this would take some time, which I fully appreciated. Marc informed me that on good Friday he would send me A partial refund of £130, however late on Friday He contacted me to say that after taking advice on this forum he would require me to send the goods back before he could issue a refund as potentially end up being £400 out of pocket and not have the figures. I explained by returning the figure I would be in exactly the same position, hence the mexican stand off. I informed marc that if I wished to rip him off I could easily contact my card provider and initiate chargeback, for which i would be fully refunded and he would incur a hefty fee from Paypal, trust me I have been there.

I fully appreciate the views members have posted on this forum, particularly as no one knows me from adam. U have 100% feedback from over 1050 transactions on ebay. My prefered solution to resolve this issue is for Marc to send me half the money and I will return the figure and then send the second figure after receiving the remainder.

Although I feel alot more assured after reading this thread that marc is genuine, for me this had become a matter of principle and that i feel that trust so far had come mainly from my side.

Anyway hipefully after reading this message marc will believe I am a man of my word and will agree to my proposal.

Going slightly off topic I have been reading visiting this site for a few weeks now and would like to say that i have been impressed by the members knowledge, friendleness and their excellent collections.

Welcome aboard Brian - you are more than welcome to hang around as this is a great place for all things vintage - and the banter is not too bad either (have you met Todd yet?)

With regards to the whole TT thing - this has been a big shitstorm ever since the evidence came to light - it is till not resolved and more than likely never will be - guys are posting pictures up all the time of their cards and in certian cases they are receiving the bad news. Jason, one of the prime movers in all of this has just sold his set on eBay with full disclosure and taken a heavy loss

As for Marc he is a good guy and I am sure this deal with end happily - however I get your point of view and thing that your proposal is more than fair

Good luck with your collecting and don't be put off by the whole TT thing - there is always plenty to learn but most of this is picked up on the way

Thanks for the warm welcome and I believe marc and myself will reach an agreement.

After reading up on the toytoni issue I have decided to focus my collecting on attempting to get a nice set of Palitoy 12 backs afa 85 if possible, although I appreciate this will be both difficult to find and expensive, and possibly some POTF figures.

I have genuine sympathy for anyone who has lost money on their purchases because of the Toytoni fiasco. I remember back in the early 90's when i begsn rebuilding my vintage collection and dealing with the likes of Jim Stephenson and Jason Joiner but I wont go there.

Anyway i hope to become a regular contributor to this site and as mentioned if anyone is thinking about selling Palitoy 12 backs or Potf figures please feel free to get in touch
