Legal folk - employer notice period

Quick question - I've been offered a new job. Hooray! Only problem is that my current contract requires I give three months notice, and the new company want me to start in one month.

Is there anything my current company can actually do to enforce the 3 months?
 
They cannot force you to work the 3 months in all reality, but they could turn nasty and take 3 months pay off/from you as you have a legal contract for that period. (most likely they wont pay you your next paycheck or holday entitlement)

It could be taken to court but may not be in their interest to spend time on that. So its up to you to take the risk.

You could always hand your notice in and go off sick and work from hom efor the other company lol
 
I have to agree with Andy. No one can force you to work but they can refuse to pay you as you have broken the terms of the contract. If it were me and they said i couldn't leave in a month i would book as much holiday as i could and then leave.
Hood luck with it anyway.
 
i think it depends on the company weather they will be an arse with you or not, as in is there some one who can cover your job so you leaving wont put them in the **** so to speak? if there is and you aint been a naughty boy in the past i dont see any reason for them to enforce the letter of the law.
where i work they have some thing similar depending on length of service, longer you have worked there the more notice you are supposed to give, maximum of a month of the top of my head, however i have known a few people wrap in and the most i have heard any of them give has been two weeks and none of them have had any hassle regarding wages / holiday pay owed / receiving a reference

not sure Edd - all I know is that I've got three weeks left of my three months notice and it's really dragging...
 
Thanks guys - it all worked out fine! He accepted one month. Start my new job in 5 weeks 8)
