You don't need a valid auction, just tyoe his user id into this form:-

I have looked at your complaint and have come to the conclusion that this member hasn’t breached any eBay policy. If we find that there's not enough evidence of Email Forwarding System Abuse, which is the case here, we can’t take action against the reported account.
